It may be just because your website is missing one small piece of important information, or of a claim you made in one brief email you sent to one person - even if it promoted someone else's product or website. But it doesn't stop there, either. Depending on the laws and statutes in your area, the FTC can pass that complaint along to your local Attorney General. You think you're totally innocent. And your omission or improper claim was unintentional. Perhaps accidental. Still, it's considered Internet fraud - a serious criminal offence. In some cases, your website may be shut down, your business activities halted and your assets frozen pending the investigation. Your ISP may cut you off, and your computer, office equipment, email and all documents may be confiscated. If your online "venture" is just small second income, no big loss. Right? But now you have to shell out big bucks to pay for the legal costs of defending your little "hobby." And if your online business IS your livelihood, tough cookies. The government has a simple, yet effective, method of winning battles using a "scorched earth" policy. They freeze all your assets. Of course, in the meantime they've taken away your ability to buy food and pay the mortgage. Now, your chance of hiring competent legal counsel without any money to pay them is zero. In many cases, a complaint starts the ball rolling. Someone totally unknown to you alerts the government about your business or business activities by simply filing out a form online. It's that easy! Even the FTC has a "crack team" of people whose jobs are to specifically scour and surf the Internet in search for any potential "discrepancies." They may have been investigating you for some time... Without you even knowing it! "But you're not in the U.S.," you say? If you're a foreigner or operate out of another country, you're NOT immune, either. With the help of 17 International law enforcement agencies, new anti-fraud measures are now in place with powers to investigate any online business. So any website dealing from, with or through the U.S. must be compliant! (Just to give you an example, people all over the world are encouraged to file a complaint about cross-border ecommerce at www.econsumer.gov.) Bottom line, they can find you and sue you at any time. If the government wins its lawsuit, the penalties are severe. Very severe. Even if they don't, the costs of defending yourself is extremely expensive, and the process itself can completely devastate you and your family. The fines alone are scary enough, but a conviction under some of these laws is a felony and carries a nasty jail sentence. Just because you didn't mean to violate the law doesn't mean you're innocent and won't get nailed. It won't even slow down the government regulators or attorneys. ... And a host of other authorities and governing bodies. Does This Mean You Should Forget About Doing Business On The Web? Absolutely NOT! Please understand, I'm not trying to scare you out of running your own Internet business. The web is filled with opportunity, and even the "little guy" can make an insane fortune online... Without any problems... ... That is, without any problems as long as they comply! And you know what? As remarkably easy it is to run a business on the Internet, it's just as easy to be in compliance. And that's my whole point. You see, it may be a phrase here, a document there, a form here, a disclaimer there. Nothing much, really. But knowing WHICH one you do need, and WHAT wording must be used, is the hard part. Often, the expensive part, too. Why? Case #3: Commercial Emailer Fined $2,000,000.00 Recently, a California court forced an email marketer to pay $2 million in penalties for violating state anti-spam laws under "false advertising and unfair business practices" rules. A first, the judgment also substantially restricts that person's business practices, and the Attorney General will use "injunctive relief " provisions as a model in future cases. Specifically, that person is now prohibited from not only sending email or doing business on the Internet at all, but also accessing and using any computer! The judgment states that, for 10 years, that person cannot own, manage or hold any economic interest in any company that advertises or does business over the Internet. Let's say this person was running a part-time business on the Internet and working in a full-time job. Fact remains, most jobs these days require the use of computers! So in addition to coughing up $2,000,000.00 in penalties and fines, that person may well be out of a job for the next 10 years, too! That's just how serious anti-spam laws really are. Update! Since 2003, and effective January 1st 2004, a new law is now supersedes state laws. It's the new 2003 CAN-Spam Act - which covers ANY email of a business, commercial or promotional nature.
